FramtidR is concerned that our services are used safely and responsibly. Therefore, we have published this Policy to explain how we will deal with allegations that data or content published or distributed through our website by our users ("User Content") violates the rights of a third party. This Policy is relevant for both users of FramtidR services and for rights holders and other third parties who may be affected by the use of our services.
As an online service provider established in the Colombia and subject to the jurisdiction of US courts, FramtidR is not currently subject to any legal notice and takedown procedure. Therefore, we have produced this non-legal procedure to deal with claims relating to intellectual property and other rights. Readers should note that this Policy does not create any legally enforceable obligation against FramtidR.
We would like to inform you about the following features of our services:
FramtidR is not the author of any User Content;
In offering our services, FramtidR simply provides the underlying infrastructure and technology that enables the connection between external content/material through our website;
FramtidR does not participate in any way in the review - supervision of User Content and its respective intellectual property rights;
The fact that a particular item of User Content is available through FramtidR services does not represent or imply that FramtidR endorses that User Content;
Therefore, FramtidR is acting passively at all times as an intermediary ISP or host and we do not assume any responsibility for User Content available through our services.
Due to the characteristics of online services, it is possible that people may misuse the services by making User Content available that violates their rights. In addition to our goal of promoting safe and responsible use of our services, FramtidR encourages rights holders and other interested third parties to notify us of any alleged illegal use of the service, including, in particular, data or content that belongs to you.
FramtidR can only deal with your complaint if it relates to specific data or content alleged to be illegal that is used through our services.
Before submitting a complaint under this Policy, we recommend that you take steps to identify and communicate with the publisher of the alleged illegal data or content to request that they cease to use it.
If you cannot identify the publisher or if they refuse to send the request to remove the User Content, you can send us your complaint by email to: administrator@framtidr.com or you can write to us at the following address:
FramtidR Bogotá, Colombia
Make sure to attach/comment the information detailed above. The person submitting the complaint is responsible for ensuring that the complaint is unambiguous, correct, complete, and made in good faith.
For us to deal with it as quickly as possible, your complaint must contain at least the following information:
Your contact details and (if applicable) if you are acting on behalf of another person;
A brief description of the alleged illegal User Content and an explanation of why you are claiming that the User Content is illegal, unlawful, or otherwise harmful to your privacy, intellectual property, or other rights. For defamation complaints, you must set out the corresponding statement and explain why the statement is defamatory of you;
(If known) the name of the person who has posted the User Content or other information sufficient to enable FramtidR to locate the reported User Content;
Copies of any correspondence you have had with the publisher of the User Content;
If the complaint relates to an alleged infringement of an intellectual property right, such as a copyright or trademark, you must include evidence that you are the owner or legitimate holder of these rights or that you have the right to act on behalf of the mentioned party;
Any other information that you think might be useful to us.
Once you have provided FramtidR with all the information mentioned above, we will review your complaint. We will evaluate complaints on the basis of applicable law, regulations, and codes of practice, as well as our Terms of Use for our services. We will deal with complaints as quickly as possible, but we reserve the right to ask you for additional information or to seek independent legal advice.
If a complaint reveals a case of rights violation or any other form of illegal content, we will normally disable access to the User Content and/or remove it from our systems. We will also remove User Content when we have received a Court Order in accordance with Section 12 of the Defamation Act 1996 in the Colombia. User Content that has been removed may be stored by us to comply with certain legal obligations.
If a user of our services objects to the action we have taken regarding their User Content, they must notify us within seven (7) days. We would not normally re-enable access to content that is the subject of a complaint unless the publisher can provide us with a certified copy (*) of a settlement agreement signed or a sealed order from a court of competent jurisdiction, which is not subject to any right of appeal: that conclusively determines the publisher's right to use the User Content (including the right to publish and communicate the User Content to the public). In such cases, we still reserve the right to refuse to allow the User Content back on our services. We do not have to provide the user with any reason for such refusal.
* A certified copy is one that has been certified as a "true, complete, and current copy of the original" by an attorney, notary public, or person of equivalent standing in your country of residence.
FramtidR may update its privacy policy from time to time. When we change the policy in a material way, a notice will be posted on our website along with the updated privacy policy.
